This Privacy Policy explains how Fleetune collects, uses, discloses, retains, and protects personal information in connection with its North America services, including the FleetTune US Driver mobile application. The Driver app is provided to delivery drivers operating on behalf of a dispatching organization, employer, or contracting company (the "Operator"). This Policy is drafted for publication on us.fleetune.com as the privacy policy link required for Paddle checkout verification and app marketplace review.

1. Scope and Roles

This Privacy Policy applies to Fleetune's websites, the FleetTune US Driver mobile application, applications, dashboards, APIs, route optimization tools, dispatch tools, tracking tools, notification tools, settlement support, documentation, and support channels made available for North America customers.

Fleetune provides business-facing logistics and fleet operations software. Our customers decide how to configure the Service and what data to submit. For personal information that Fleetune processes on behalf of a business customer, Fleetune generally acts as a service provider or processor and the customer is responsible for providing required notices, obtaining required consents, setting user permissions, and responding to privacy requests unless a written agreement says otherwise.

For the FleetTune US Driver app, the Operator generally controls route assignments, driver access, delivery records, retention instructions, and how driver activity is used in its dispatch and operations. Fleetune provides the app and related infrastructure so the Operator can assign, route, monitor, and document deliveries.

For information collected through Fleetune's own website, account administration, sales, marketing, billing coordination, security, support, and business operations, Fleetune generally acts as the business or controller responsible for that processing.

When a purchase is completed through Paddle checkout, Paddle acts as Merchant of Record or authorized reseller and processes checkout, payment, tax, fraud prevention, invoicing, refund, and order-support data under Paddle's own terms and privacy notice. Paddle may share buyer information with Fleetune as needed for product fulfillment, order processing, fraud prevention, and product support.

2. Who This Policy Covers

This Policy may apply to customer administrators, dispatchers, fleet managers, operators, drivers, contractors, delivery personnel, business contacts, website visitors, support requesters, prospects, buyers, billing contacts, and delivery recipients whose information is submitted to or processed through the Service.

This Policy does not replace any privacy notice or policy that a Fleetune customer must provide to its own employees, contractors, drivers, customers, delivery recipients, or other individuals. Customers are responsible for ensuring that their use of Fleetune complies with applicable privacy, employment, labor, communications, transportation, and location-tracking laws.

3. Notice at Collection and Categories of Personal Information

The table below summarizes the categories of personal information Fleetune may collect or process in connection with the Service. Not every category applies to every person or customer account.

Fleetune does not intentionally collect Social Security numbers, government identification numbers, health information, biometric identifiers used to identify a person, or payment card security codes through the Service. Customers should not submit such information unless Fleetune has expressly agreed in writing that the Service is configured for that purpose.

4. Sources of Personal Information

Fleetune may collect personal information directly from you, from customer administrators, from authorized users, from drivers or device users, from delivery records submitted by customers, from APIs and integrations configured by customers, from Paddle and other payment or order-support providers, from Google Firebase services used for Cloud Messaging, Analytics, and Crashlytics, from mapping, messaging, analytics, security, and cloud service providers, from publicly available business sources, and from your browser, device, or app interactions with the Service.

If you are a driver, dispatcher, contractor, employee, customer, or delivery recipient of a Fleetune business customer, much of the information processed through Fleetune may have been provided or configured by that business customer rather than directly by Fleetune.

5. How Fleetune Uses Personal Information

Fleetune uses personal information to provide, operate, maintain, secure, improve, and support the Service; create and manage accounts; authenticate users; configure workspaces; assign routes; optimize routes; support dispatching and tracking; display location and delivery status; share live location and delivery status with the Operator's dispatch console; calculate estimated arrival times; provide proof-of-delivery workflows; store delivery photos and signatures for the Operator's records; send operational push notifications; process support requests; coordinate subscriptions and billing; reconcile orders with Paddle; prevent fraud, abuse, and security incidents; diagnose crashes and errors; debug and improve product performance; comply with legal, tax, accounting, and contractual obligations; enforce terms and policies; and communicate about product updates, service notices, and optional marketing.

Fleetune may also create aggregated, de-identified, or anonymized information that does not identify a person or customer and use it for analytics, benchmarking, product improvement, security, operations, and business purposes.

6. Location, Driver, Vehicle, and Delivery Data

Fleetune's Service may process precise or approximate location information, route history, timestamps, vehicle identifiers, driver assignments, stop details, delivery addresses, delivery recipient details, proof-of-delivery materials, signatures, photos, notes, and status updates.

When a driver uses the FleetTune US Driver app on an active route, the app may collect the device's precise GPS location, including while the app is in the background or the screen is off. Background location collection is intended to support live dispatch tracking, delivery progress, ETA calculation, route guidance, and customer-configured operational visibility. Background location collection stops when no active route is in progress.

The Driver app may collect delivery photos through the device camera and recipient signatures when a driver marks a stop as delivered. The app may also process the driver's phone number, name, assigned vehicle, assigned unit, recipient or delivery contact details, contact records used for delivery communication where configured or permitted, push notification token through Firebase Cloud Messaging, device model, operating system version, app version, basic usage and diagnostic events through Firebase Analytics, and crash or error diagnostic data through Firebase Crashlytics.

Location and delivery data can be sensitive because it may reveal an individual's movements, work patterns, delivery addresses, or operational details. Customers must provide appropriate notices, obtain required consent or other legal basis, and configure the Service in a way that is lawful and proportionate for their workforce, contractors, customers, and delivery recipients.

Fleetune uses this information to provide route optimization, dispatch visibility, driver guidance, customer tracking, operational reporting, troubleshooting, security, and service improvement. Fleetune does not sell driver app personal information and does not use driver or delivery-recipient location data for unrelated consumer advertising.

Drivers may disable location, camera, or notification permissions in device settings, but disabling location will prevent the Driver app from functioning for active deliveries and disabling camera or notifications may limit proof-of-delivery or operational update features.

7. Paddle Checkout, Payments, Taxes, and Refunds

If you purchase Fleetune through Paddle checkout, Paddle may collect and process buyer name, email address, billing address or location, tax information, payment method details, fraud-prevention information, transaction information, invoice details, subscription status, and refund or chargeback information.

Paddle, not Fleetune, generally handles payment card processing, tax calculation, invoicing, refund mechanics, and first-tier order support for Paddle transactions. Fleetune may receive from Paddle information needed to activate the Service, confirm payment status, provide product support, investigate fraud or chargebacks, respond to buyer requests, and reconcile subscriptions or refunds.

Please review Paddle's privacy notice and buyer terms for details about Paddle's processing. Fleetune's use of buyer information received from Paddle is limited to the purposes described in this Privacy Policy, the Fleetune Terms of Service, applicable order documents, and applicable law.

8. Cookies, Analytics, and Similar Technologies

Fleetune and its service providers may use cookies, pixels, SDKs, local storage, log files, and similar technologies to operate the website, Driver app, and Service, remember preferences, maintain sessions, improve security, measure performance, analyze usage, diagnose errors, and improve products.

For the FleetTune US Driver app, Fleetune may use Google Firebase Cloud Messaging to send route and operational notifications, Firebase Analytics to understand basic app usage and reliability, and Firebase Crashlytics to collect crash and error reports that help Fleetune fix problems.

Some browser or device settings allow you to block or delete cookies. If you block required cookies, some website or Service features may not work correctly. Where required by law, Fleetune will provide consent or preference controls for non-essential cookies.

As drafted for the North America launch, Fleetune does not sell personal information for money and does not intentionally share personal information for cross-context behavioral advertising. If Fleetune later uses advertising technologies that constitute a sale or sharing under applicable privacy laws, Fleetune will update this Policy and provide required opt-out mechanisms.

9. How Fleetune Discloses Personal Information

Fleetune may disclose personal information to cloud hosting providers, security providers, Google Firebase Cloud Messaging, Firebase Analytics, Firebase Crashlytics, analytics providers, support tools, communications providers, messaging carriers, mapping and geocoding providers, integration providers, professional advisors, affiliates, Paddle, payment and order-support providers, tax and accounting providers, and other vendors that help provide, secure, support, or improve the Service.

Fleetune may disclose information to customer administrators, Operators, dispatch consoles, and authorized users according to the customer's account configuration. For example, a customer administrator or Operator dispatcher may be able to view driver, route, live or historical location, delivery, proof-of-delivery, user, support, and account activity associated with that customer's workspace.

Fleetune may disclose information when required by law, subpoena, court order, regulator, payment network, tax authority, law enforcement request, or legal process; to enforce terms and policies; to protect rights, safety, security, and property; to investigate fraud, abuse, security incidents, refunds, or chargebacks; or in connection with a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.

10. Legal Bases Where Applicable

Where a legal basis is required, Fleetune may process personal information to perform a contract or take steps before entering into a contract; based on legitimate interests such as providing, securing, improving, supporting, and marketing the Service; to comply with legal obligations; to protect vital interests or safety where relevant; with consent where required; or as otherwise permitted by applicable law.

Individuals may withdraw consent where Fleetune relies on consent, subject to legal, contractual, technical, or operational limits. Withdrawing consent may affect the availability of certain Service features.

11. Retention

Fleetune retains personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Service, maintain accounts, support customers, comply with legal and tax obligations, resolve disputes, enforce agreements, maintain security, prevent fraud or abuse, and maintain backups.

Driver app location and delivery records are generally retained according to the Operator's instructions, account settings, contractual requirements, internal policies, and applicable law. Diagnostic and analytics data collected through Firebase Analytics and Crashlytics is retained for a limited period consistent with Fleetune's operational needs and applicable service-provider defaults or settings.

Retention periods vary depending on the type of information, customer configuration, subscription status, legal requirements, backup cycles, dispute needs, and operational requirements. Customers may request deletion or export of customer-controlled data according to their agreement, account settings, and applicable law.

12. Security

Fleetune uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, copying, use, modification, loss, and destruction. Safeguards may include access controls, authentication, encryption in transit or at rest where appropriate, logging, monitoring, vendor controls, and personnel confidentiality obligations.

No method of transmission, storage, or processing is completely secure. Customers are responsible for configuring appropriate user permissions, device controls, integrations, API key practices, driver access, data exports, retention settings, and internal access rules.

13. International Transfers

Fleetune may process and store personal information in the United States, Canada, South Korea, the United Kingdom, the European Economic Area, and other countries where Fleetune, Paddle, customers, affiliates, or service providers operate. These countries may have privacy laws different from those in your location.

Where required, Fleetune uses appropriate safeguards for international transfers, such as contractual commitments, data processing agreements, vendor due diligence, and other mechanisms permitted by applicable law.

14. Your Privacy Choices and Rights

Depending on where you live and your relationship with Fleetune, you may have rights to request access to personal information, deletion, correction, portability, restriction, objection, withdrawal of consent, opt-out of certain processing, appeal of a privacy request decision, or information about how personal information is collected, used, disclosed, sold, or shared.

Driver app users can disable location, camera, or notification permissions in device settings. Disabling location will prevent the Driver app from functioning for active deliveries. If your information is controlled by an Operator, you should contact that Operator to access, correct, or delete driver, route, delivery, or employment-related records.

To submit a request, contact Fleetune at biz@fleetune.com. Fleetune may need to verify your identity and request details before responding. If your information is controlled by a Fleetune business customer, Fleetune may direct your request to that customer or respond on the customer's behalf according to the applicable agreement.

Fleetune will not discriminate against you for exercising privacy rights that apply to you. Some requests may be denied or limited where an exception applies, such as security, fraud prevention, legal compliance, tax, accounting, dispute resolution, contract performance, another person's rights, or information controlled by a customer.

15. U.S. State Privacy Notice

Residents of California and certain other U.S. states may have additional rights under state privacy laws, including rights to know or access personal information, delete personal information, correct inaccurate personal information, obtain a portable copy, opt out of sale or sharing, opt out of targeted advertising, opt out of certain profiling, limit certain uses of sensitive personal information, and appeal a denial of a privacy request.

Fleetune does not sell personal information for monetary compensation. As drafted for launch, Fleetune also does not intentionally share personal information for cross-context behavioral advertising or targeted advertising. Fleetune uses sensitive personal information, including precise geolocation where applicable, only for Service operation, security, legal compliance, customer-configured logistics workflows, and other purposes permitted by applicable law.

If Fleetune later offers a Do Not Sell or Share mechanism, Global Privacy Control support, cookie preference center, or other opt-out tool, Fleetune will provide the relevant link or control on the website or within the Service.

16. Canada Privacy Notice

For individuals in Canada, Fleetune handles personal information in line with applicable Canadian private-sector privacy principles, including accountability, identifying purposes, consent, limiting collection, limiting use, disclosure and retention, accuracy, safeguards, openness, individual access, and challenging compliance.

Where consent is required, Fleetune or the applicable customer will seek meaningful consent appropriate to the sensitivity of the information and the reasonable expectations of the individual. Individuals may contact Fleetune with access, correction, consent withdrawal, or privacy compliance questions, subject to legal or contractual limits.

17. Children

The Service, including the FleetTune US Driver app, is intended for business use by professional users and is not directed to children under 16. Fleetune does not knowingly collect personal information from children under 13 or from minors where parental consent is required by applicable law. If you believe a child has provided personal information to Fleetune, contact Fleetune so that appropriate action can be taken.

18. Third-Party Links and Integrations

The Service may link to or integrate with third-party websites, applications, maps, messaging services, payment services, app stores, marketplaces, customer systems, and partner services. Fleetune is not responsible for the privacy practices of third parties. Review their privacy notices and terms before providing information to them or enabling integrations.

19. Changes to This Privacy Policy

Fleetune may update this Privacy Policy from time to time to reflect changes in the Service, integrations, Paddle checkout configuration, legal requirements, or privacy practices. The updated Policy will be posted with a new effective date. If changes are material, Fleetune will provide additional notice where required by law or commercially reasonable.
